Terms and Conditions

This document explains the terms and conditions relating to the supply of goods or products listed on our online store to you.  Please read these terms and conditions to ensure that you understand them before ordering.  By ordering any of our products, you agree to be bound by these terms and conditions.

 

  1.  Information about us.

Alchemist Gallery online store is operated by North Coast Creatives Ltd, and we operate the website www.alchemistgallery.co.uk.  We are based in Dingwall, Scotland, UK.

  1. Ownership of goods

Ownership of goods offered for online sale remain the property of Alchemist Gallery or their suppliers until payment is received in full.

  1. Representation of goods

Every endeavour is made to provide accurate information about the products we sell.  We take care to ensure that website photographs depict colours as accurately as possible, but variations may occur due to limitations in photographic reproduction or the colour settings on different types of computer monitors.  As all our products are handmade, and are unique or made in small batches, slight variations of weight, colour and finishes may occur between items.  If any goods are unsatisfactory, we will accept their return according to our cancellation/returns policy.

  1. Contract

After placing an order, you will receive online confirmation that we have received your order and payment.  All orders are subject to acceptance by us.  The contract between us will only be formed when you receive the products.  Contract terms and conditions are concluded in the English language.

 

5. Your status

When you place an order through our website, you are confirming that you are legally capable of entering into binding contracts and that you are at least 16 years old.  It is the responsibility of the purchaser to ensure that a correct and valid delivery address is entered.  We reserve the right to charge an additional fee if an incorrect address is supplied and the goods require to be posted again

  1. Delivery of Products

Products will be delivered by Royal Mail or carrier.

Your order will be dispatched within a reasonable time of the date of order as indicated on the online shop information unless there are exceptional circumstances that do not permit this.  Delivery may take 7 to 14 days, although goods are usually dispatched within 48 hours.  Delivery of products may be carried out by one of our suppliers.  Goods will not be dispatched until cleared funds are received. 

  1. Customs (non UK)

All goods supplied outwith the UK, including to European Union Countries now need a customs declaration. VAT at the UK rate is included, where appropriate, in your total invoice. All international packages are accurately described, with costs, on the customs declaration document. Additional charges for customs clearance and import duties must be borne by the buyer as we have no control over these charges and cannot predict what they might be. Since customs policies vary from country to country you may wish to contact your local customs office for further information.

  1. Goods out of stock

The website is updated regularly.  However, if you order an item which is out of stock prior to dispatch, we will contact you in order to give you the choice of ordering an alternative, placing on back order until new stock is received, or receiving a refund.

  1. Cancellation/returns.

You have a statutory right to cancel your product order for any reason and receive a full refund, except in the case of:

  • Earrings which have been worn.

  • Commissioned or personalised items.


Other than the excluded items, you will receive a full refund of the price paid.  Your statutory right to return a product starts from the date when you received the product.  If the product has been delivered to you, you may return the product at any time within 14 working days, starting from the day after you receive the product.  In the event that you have received a product that is damaged on delivery, then please inform us of this, in writing, as soon as possible.  If a product is returned to us damaged and you have not informed us that the product was damaged when you received it, then we may refuse your right to cancel or receive a refund.  You must return the product to us as soon as reasonably practicable.  You have a legal obligation to take reasonable care of the product while they are in your possession. Please note that unless the goods are faulty or misdescribed, you will be required to arrange and pay for transportation of returned goods yourself.

 

10. Price and Delivery Costs

The price of our products are as stated on the website, with additional delivery costs shown and added at checkout, depending on product size, weight, value and chosen delivery location.

These prices are for customers ordering from the UK, and delivery within the UK only.  If ordering from outwith the UK and for orders to be delivered outwith the UK, please contact us for details of additional delivery charges and delivery times.

Where a purchaser opts to collect items purchased online directly from 48 High Street, Dingwall, no delivery charges are applied at checkout.  

Prices and charges are liable to change at any time but changes will not be made once an order is placed. 

 

11. Refunds

If an order is cancelled in accordance with paragraph 9 above, then we will refund the amounts owed as soon as possible following cancellation and in any case within 30 days following cancellation.  Refunds will be made to the credit or debit card used to carry out the original transaction.

 

12. Privacy Policy

Your credit card information is not held by us and contact details are held only for the purposes of delivery.  We will not trade, resell, sell, or redistribute information that you provide to us, to any other companies, organisations or individuals.

 

13. Customer Service

We want you to be happy with both your purchases and the service you receive from us.  If you have a complaint, please contact us immediately by phone or email and we will do our utmost to resolve any issues you raise.

 

14. Force majeure

We reserve the right to defer the date of delivery or to cancel a contract for all circumstances beyond reasonable control, including but not limited to any strike, lockout, disorder, fire, explosion, accident or stoppage affecting our business or work which prevents or hinders the delivery of the goods.

 

15. Law and jurisdiction

These terms and conditions and any dispute arising out of or in connection with them or their subject matter or formation (including non contractual disputes or claims) will be governed by Scots Law.  Any dispute or claim arising out of, or in connection with these terms and conditions or their formation (including non contractual disputes or claims) will be subject to the non exclusive jurisdiction of the courts of Scotland.
